Title: Judge denied our Motion for Continuance--- Post by: stuckinbetween on February 05, 2013, 12:28:17 PM So we're back on for tomorrow. I had do some serious shuttle diplomacy to get my L. and the forensic accountant (FA) to even speak to each other, but both are now working diligently on my behalf.
In the most bizarre twist, it turns out the FA is a close and dear friend of the opposing counsel (OC). My L. knew that they were friendly, but not that they were close friends. The FA has sought solace with the OC in recent days over her anger at my L. But my L. and the FA have been a very effective team for many years, so L. was completely blown away. At least they've decided to delay their shoot-out or shout-out until the trial is over on the 11th. Maybe I can breathe a little now. It's been touch and go for days. It's bated breath, but at least it's breath. Please keep me in your thought and prayers. I'll let you know how things are going. Glad to hear it's back on track. It's well known that relationships and business often don't mix well. Misunderstandings, different expectations and assumptions, a stray comment, etc. And that's when you're dealing with reasonably normal people!

Title: Re: Judge denied our Motion for Continuance--- Post by: stuckinbetween on February 06, 2013, 07:34:51 PM First day of trial. attorneys made opening statements. NPDh's attorney lied. She said h had always been a loving and doting husband (which he was for over 2 decades and I was a loving and doting wife.) She said the divorce was my idea (crazy) and that I'd stolen money first (more crazy)
The morning was taken up with procedural stuff but in the afternoon my L. and my FA (forensic accountant) actually performed beautifully together. They were able to show a sample of 6 mo. of credit card statements showing that he and his paramour/business partner lived rather lavishly and not only paid off their purchases in full, but overpaid every month by thousands of $. Can anyone think of why he would do that? Needless to say my h did not look good in court today. The judge overuled the many objections from opposing counsel where she tried to bar the FA and the evidence. I am thoroughly wiped out. Will let you know what tomorrow brings. Sending many virtual hugs -- hang in there. We're pulling for you. This one's very easy, if they spend it - you can't have it, and, and if they can't have it, they will spend it. Basically if we can't get our way, you can't either and we will destroy what you want. Abuse, financial abuse, whatever. Typical. Title: Re: Judge denied our Motion for Continuance--- Post by: scraps66 on February 07, 2013, 11:17:45 AM PS When my ex was confronted about why she fraudulently broke into my bank account and took $2000 to pay bills, including credit cards, she said, "My credit is very important to me." Rationalization.
From my perspective, this sounds like ti went even better than could have been imagined. The judge overruled the many objections from opposing counsel where she tried to bar the FA and the evidence. It's stbx's lawyer's obligation to provide a legal defense for his client and one of those ways is to say "I object" to as many things as possible that favor you or disadvantage his client. It's up to the judge to decide whether to sustain or overrule. Likely those objections and even insinuations were not 'personal' against you, just his job, part of the game, er, procedure. |
