Title: What's her obligation on the lease?

We're getting into the finer details of who owes what.

Both her and I signed the 12 month lease on our house, then she moves out a month later. 

So I'm stuck with a $1300 payment I can't afford while her new place is $850.

Does anybody know if she would be obligated for some of the $1300?

We had a similar situation where there was a 5 year business lease with 3 years remaining. Turns out she doesn't have to pay for any of it, but we can't remove her, and there is a chance that she will be paid out a portion of the deposit when all is said and done even though none of it is hers.  The only way they would go after her is if the business defaulted and rent was not paid.

Some landlords will allow you to get out of the lease if you agree to pay to advertise the place yourself and help show it and fine a new tenant.  I used to be an apartment manager, and we had a few breakups along the way, and that is how I handled it.  I just needed communication from the tenant.  The ones that kept me in the loop, the owner was better about letting them out of late fees and leases etc.

PS- Not saying you can't ASK for it in court, because you can ask for anything.  Just saying it has been my experience that you can't have an expectation to ever get anything. If you default and leave it will affect both yours and her credit though, and the creditors will go after anyone on the lease.
