Title: how to get the title of my car from N/BPDx?
Post by: livednlearned on April 18, 2013, 12:25:54 PM
As part of my divorce settlement, N/BPDx is paying my monthly car payment. Next month is the last payment and the car will be fully paid. I want to transfer the title into my name only.

Ideally, I'd like to do this without paying my attorney. Wish I had included in the decree that N/BPDx was ordered to transfer the title after paying it off. I don't have that in writing, tho. At least not in that direct language.

Has anyone else had to do this? What kinds of things can go wrong in BPD world? I don't trust that he will actually go to DMV and fill out the transfer of title form.

Thx!

Contact the holder of the loan and title and give them a copy of your divorce papers. They will be able to tell you how to proceed.

I agree, by default they would normally just return the title to the named owner with the lien cancelled.  What you want to do is see if you can influence the title to come to you.  If in his name, there may be complications.  First hurdle is creditors and where they'll return the title, second is getting it from ex if it is sent to him, third is getting the state agency to agree to transfer title to your name if ex didn't sign it over to you.

The title has both of our names on it -- I changed the address so that everything would come to me, but who knows what they will do when the car is paid off.

I'm thinking that maybe I can get this taken care of at the same time I sign all the documents for the refinance of our mortgage... .

I hope you have better luck and more cooperation than I did.  I paid off my own car just to get his name off of it, and then he refused to sign.  He had gotten it for me as a birthday gift in 2009 and then left me the payments.  He didn't want me to get rid of it (and my memories of him), so it took me a year and a half to get him to sign.  I brought it to our final court hearing, and my attorney gave it to his in front of the judge, so he had to sign.  It was worse than that with our last joint bank account.  I tried everything, but cooperation with me just isn't in his vocabulary any more.  Good luck.
