Wow... . just discovered this section. Our BPDs is being taken to court for termination of parental rights. We live 1000 miles away, so we dont know the whole situation. Im guessing because he is very irresponsible. We want to be part of our grandaughters life and have hired a lawyer to see if this is possible if he loses his rights. Anyone have experience with this?  He lives in NewMexico

The more important question is do the child live in New Mexico? The law that is applied is the law of the state the child resides in.

I am guessing that because you are talking about getting a lawyer, that your relationship with the child's mother isn't great. But it also seems that you aren't under any illusions that BPDs has a real problem. How reasonable is she? Would it be possible to talk this out? The second you bring a lawyer into the situation you will put her on the defensive. Try everything else first and if that doesn't work then get a lawyer, would be my advice. But document what you tried so that if you have to get a lawyer you can show the court it was a last resort.

Many states do have grandparent's rights. But they can be very different from state to state. In the state I am dealing with, if the Father is alive and has any visitation at all it is presumed by the court that his parents will be able to utilize some of his visitation time and nothing extra is awarded. But again, it is very different from state to state.
