Title: Subpoenaed? Post by: Frank88 on March 13, 2016, 10:27:20 PM BPDEXGF has a son with her ex husband. I believe her ex husband wants more custody. Could I be subpoenaed to testify against my exgf because of what I know about her. We all live in a small place and people know that both her ex and me went through similar issues with her. If he goes to court, could I be called? I don't want to say what state we live in. Just general experience.

One thing to keep in mind is that courts aren't that concerned with a parent's mental state (adult behaviors) except where it substantively impacts the child's life (parenting behaviors). That's what her exH ought to be focusing on. Her adult behaviors may be factors that help him, but what his child sees, hears and experiences would be of greater impact for his case. My case was the type that went on relentlessly and there were better tactics and strategies than bringing in character witnesses.
You could be called in as a witness, though how often that actually happens is anyone's guess. More likely is the scenario where there is a custody evaluation and the professional doing the evaluation interviews close friends and family in addition to the parents, child, and home visits. I don't think we would contact any of uBPDbm's romantic partners because we have no idea what they would say. Good Ls say "Never ask a question that you don't already know the answer to". I just know through friends that lawyers are involved on both sides. I don't want to be caught up in any of it. I agree, if it happened it would be through the courts.
