Title: Can I complain about the CE again?
Post by: Thunderstruck on June 15, 2016, 09:23:02 AM
I looked up our CE on the court records search and found out that she is presently being evicted from her office. Oh joy.

(She is also going through her own divorce. She is a mess.)

We are 23 months into this evaluation.    DH got an email from her last week that said she had come back from another "emergency medical leave" and is diligently working on the report every single day. Yeah sure, we've been hearing that for over a year now.

In the meantime, we have been asking her for months to please wrap this up so we can get something in place before SD11 goes to middle school. Now it's two months until school starts and uBPDbm is threatening to move SD11 to another school. So... .more money wasted because we have to go to court to get this straightened out.

Please complain about the CE as much as you want.  I will be the first to promise to buy your book when it comes out.  :)

I know they hate when you bother them, but it seems highly logical to check with her supervisor at this point.  You could even play dumb and say you were trying to get in touch with the CE, but accidently called their number instead.  Then go ahead and explain a little of what's going on since you already have them on the line.

I know it's not always good to make waves, but no one should have to stand for this.  This has almost hit the level of suing her in small claims court.  What about just talking to another CE to offer to contact her directly requesting a copy of her report to review, just to light some fires?  Cheaper than hiring a new CE (and maybe free if the CE doesn't actually need to review it/is sympathetic to your situation).

I've got nothing... .  ... .Maybe tell her the inquiring minds of your anonymous online support group are getting anxious  lol

Yup, you can vent here and we will certainly listen.

The upshot is that at least she is communicating with you herself rather than not being able to get ahold of her and having her office tell you she's "almost done" as in the past.

I'm so sorry this has gone off the rails.

I would at the very least be preparing a letter to write to the psychology board to have her license censured. As soon as you do get this darn report.

She has willfully placed a minor child at risk for over a year while she dealt with what ever she dealt with, I'm sorry her life is hard, but ethics state she should have excused herself. Which simply makes her greedy and unprofessional.

Can't your attorney send a letter by certified mail stating that she has until July 1st to email the report or you want a full refund and she will be turned over to the licensing board?

I think our L wants to coerce and not threaten. We have a court hearing coming up July 8th (to get us residential for school so SD11 can go to her middle school). Our L wants to send the CE a letter saying that the judge will probably be concerned about how long this is taking, hoping that will spur the CE to finish before then.

July 12th will be two years since the CE was ordered.

She should have recused herself from being CE once the delays continued.  Delays to happen, the question is to what extent.  I've heard of some taking up to a year but this is unreasonable.

My custody evaluator was given 4 months for his evaluation.  My Ex, bilingual and a medical and legal certified interpreter, filled out her psych tests in her parent's native language and so forced the CE to delay the court hearing for about a month so he could hire an interpreter.

Is there a report yet?  Surely it doesn't take two weeks to write one!

Sanemom, you are silly.  Of course it doesn't take two weeks to write an eval.  It takes two YEARS!

Thunderstruck - this is for you
