Title: Can you sue?
Post by: gah on July 04, 2016, 11:54:20 AM
My ex non diagnosed BPD and I bought a house together.  He was cheating, lying, and when he got violent I left.  This all happened within two months of home ownership.

I am now a year out and see clearly.  I feel that the stress and giving up my life to move to our own house deserves some sort of compensation.  He immediately moved in with my replacement while keeping our house.

I was not on title of the house  ... .is there something else?

If you aren't on title, you don't have any legal claim to the home and in the eyes of the law, it was never your home.  Hopefully, you aren't named on the loan, and have a legal obligation  to pay for the home.

A landlord tenant situation, could have some legal recourse, but I don't think there would be much to do in the situation of a romantic partner moving into the other partner's home.

I'm sure you can find a lawyer who will sue for anything, but you have to invest a lot of money and could lose the case.  lawyers in my area are $350/hr and the cost adds up fast.  There are court fees that add up as well.

You might be able to do a small claims suit.  Every state has a different dollar limit on how much you can sue for.  Best to do a reality check.  Is it worth the frustration of documenting and preparing for a small claims suit?  If so, then perhaps you want to pursue that.  Another choice is to journal about it, maybe get some therapy, vent about it in healthy ways.  The greatest revenge is to move on with your life and be happy.
