Title: Child support issue, he wants to pay less
Post by: Dontknow88 on September 14, 2016, 02:50:13 PM
Ok so we live in different  countries he's paying the amount he should for his country but for my county's legal calculations what I'm getting Is a couple hundreds more. (We agree on the amount our self, he knows it's more) but now he doesn't want to pay that amount anymore (been paying for 8 months now) and wants to pay my country amount (legally my country amount *less payment* matters more and not what he's suppose to pay for his country cause out child was born in my country). I'm not working right now (I do plan to go back, health reasons and baby) and the money helps out a lot , is there a way I can still get the same amount in court ?

This is purely a legal question, best left to a lawyer who knows how the two countries' laws handle this situation.  Based on what you wrote, I suspect the judge will side with him unless you introduce reasons why the smaller calculation for your country isn't enough.  Depending on your local laws, a judge may enforce a larger amount if the circumstances deem it appropriate.

That being said, you need to calculate how many total dollars you're talking about and see if it's worth fighting over in court.  For example, if you plan on going back to work in 10 months and you're only talking about $200/month difference, that's $2000 you'll be fighting over.  Would your legal bills fighting over this amount end up more than this amount?  Are the odds of you losing this higher than winning?  You may be better off just conceding this to him.

I get $950 more than I should legally and as my child gets older I've noticed he needs more things So it's a Huge difference

Wow!  You originally said "a couple hundreds more".  Maybe you meant something other than dollars?  :)

So this is definitely something worth to consult a lawyer about.
