BPDxw has started a go fund me page and has slandered my DH mercilessly. Since go fund me is a public forum / webpage I wonder if this could be seen as defamation of character. From a little light Googling on defamation of character, it seems to me that you need to show that your husband's reputation was harmed by a relevant community (random strangers on the web probably don't qualify) and that there are damages as a result. Can you do that?
One thing I absolutely do know about the law is that a suit is going to cost you a lot of money, even if you have a good case. Title: Re: did anyone on here ever sue for defamation of character? I will ask our L as well. There is not a certain "community" that we could name. But since go fund me is a very public forum that anyone can google and then read all the horrible things, I do find it rather harming. Plus she keeps repeating all the same crap to doctors, teachers and therapists. No one has ever filed a CPD claim, but due to her claims the children's latest therapist is completely biased against my DH and refuses to communicate with him. BPDXw brought the same accusations up in court a few years ago. The judges squashed it as he saw it was bogus. She is bringing up the same thing again now for this court date. I understand that the non-BPD usually never gets away with the behaviour the BPD does, but it irks me that she can just go around telling the same story for years and publicly crying it out and there is just nothing my DH can do besides sit by and feel awful. Post by: Thunderstruck on May 22, 2017, 08:43:36 AM The first place I would start is to look at the laws in your state and see if your case meets the qualifications. From what I read in my state, the badmouthing has to affect you in some monetary way (like the slander hurting your business) in order to seek damages.
My DH's CO says that the parents are not allowed to speak badly of each other in social media. Does yours have any clause like that? If not then maybe you can ask the L/court to get one included. Maybe even a simple "Cease and desist" letter would curb the behavior. You could ask your L about that too. |
