As I write this I actually feel sad for Xw. She has been a monster and I'm not pulling in my horns one inch but her affidavit is so pathetic. Mine is full of fact and hard evidence. I'm the applicant, the onus is on me but Xw said s10 is suffering in school. The judge said, stressed he wanted hard evidence s10 was suffering in school. So it was put back in Xw lap, now prove it. My L wanted every scrap of documentation I could produce. S10 is thriving in school, third term was his best term, when his access really increased with me, teachers gave s10 glowing reviews, how he was improving. Xw insists my access is causing s10 to slip. Today I review Xw affidavit for court tomorrow and she states how well adjusted child s10 is and HOW HE THRIVES IN SCHOOL. The judge made it so crystal clear how he will be leaning on s10's poor performance in school. The whole case is built around his school and she makes that statement and swore to it.

My first thought?  Don't feel too sad until you find out what the judge does.  Beware if the judge discounts all her claims yet includes somewhere a change in her favor.  I'm not saying it will happen, it seems she is at long last wearing out her welcome and credibility in court, but my senses became very jaded in court.
