I was just curious if anyone here is going through a divorce in Texas where you and your spouse own a business together.

We have a service business together - working in homes in our area.

Does anyone know if you can request in your divorce decree that your spouse not be able to shut the business down & sell off assets and then open up the same type of company contacting existing customers in the same area to avoid having to buy you out of the company?

Well, if it's jointly owned, then there ought to be some way to address that issue.  Split the clients?  Problem is that he may still act underhanded and there may not be any money in proving he does some things wrong.  If he wants to drop out and you don't, a court may not make him stay in and frankly it's hard to imagine you would want to be in business together with him afterward.  Basically you want a clause prohibiting him from siphoning off your share of prior clients?  A no complete clause?  What are your lawyer's ideas?
