Hey Everyone,

I haven't posted for a while, I've been so busy dealing with the daily barrage of bull___ from my UPD Ex wife. 

Very long story short - my ex moved from Canada to Miami while pregnant.  She had a green card and was able to stay in Miami.  My son was born in Miami and is a U.S. citizen. 

I am Canadian, living in Miami going through a terrible divorce/custody battle with a person that makes false accusations almost daily and all kinds of other crazy behaviour.  Our strategy is to be patient and give her enough rope to hang herself with. 

My problem is I need to get a work Visa or some other way to legally extend my stay here.  For education, I have a 3 year business administration diploma and the Canadian Securities Course (stock broker course).

I've also owned/operated my own small business in Canada since 2010.  We have roughly 10 employees and do anywhere from $750k - $950 in annual revenue.

My Mom is also a dual citizen.

I also have at least 2 employers that are willing to sponsor me for a work Visa.

Can anyone help point me in the right direction to getting a legal means to extend my stay in the US?

If your mother is a dual citizen, do you have the possibility of U.S. citizenship through her? Or is U.S. citizenship her secondary (born in Canada, acquired U.S)?

If your mother is a dual citizen, do you have the possibility of U.S. citizenship through her? Or is U.S. citizenship her secondary (born in Canada, acquired U.S)?

US citizenship is her primary.  However she moved to Canada and because of some tax issues there is something wrong with her US citizenship.  She does have an accountant clearing up that issue for her now. 

Is it possible to get my US citizenship because my Mother is a born US citizen?

Is it possible to get my US citizenship because my Mother is a born US citizen?  

I think there is an age limit involved. I'm Canadian born, naturalized US citizen. For my circumstances (opposite of yours) I believe you have to submit papers when your child is a minor (under 18), though perhaps there are loopholes to that. Maybe it's the same for both countries?

I wonder if it would be worth searching for immigration lawyers who deal with child abductions and Hague Treaty protections. They may have some ideas about how to mitigate the citizenship problem while your custody case is pending. A regular immigration lawyer may not deal with cases like yours very often whereas an immigration lawyer that deals with high-conflict custody abductions may have some creative solutions or workarounds.
