My S2BX has taken a large number of family items. However, a number of items she took were in fact "pre-marital" items and not subject to any claim on her part.

Has anyone else experienced this? and were you ever successful in having said items returned?  if not, were you able to factor in the value against your spouse in the division of assets?

In my settlement we were to split some decorative china, half to her, half to me.  I had them in the house.  Silly me, I brought them all to her and asked her to choose her half.  You guessed it, she took the box and said they were all hers.  What was I to do?  We were in the sheriff's parking lot  but they wouldn't do anything to resolve the matter (except maybe get myself into trouble since I'm the wrong gender) and my lawyer said a few china items weren't going to make a difference.

So I learned the hard way to not volunteer anything.  You're right, I'm still learning, it's not easy with a rescuer personality.

Your ex has them, so in a practical manner of speaking, ex has control.  Can you prove she has them?  Even if you can't prove it, list them promptly.  Don't wait until the financials are being calculated, that's too late.  Perhaps you should 'protest' it now, so she can't claim you're too late, she never had them or they never existed.

She has stated in a text message that yes she has the equipment. They have been listed. Thing is most of these are EXCLUDED pre-marital assets. One lense is $1,500-$2,000 lens by itself.

I do plan to protest.  And I am going to ask my lawyer what we can do legally. Since they are pre-marital items. There are a couple other items that aren't even technically my property. So I am going to see what pressure my lawyer can apply to get them back.

Going thru the same thing. After I told udBPD stbx I was filing for divorce he had a melt down. He took numerous items from our home. I reported it to the police. They wouldn't do anything. He is constantly taking things. He has now coming home during the day and taking the mail.
