Does anyone know about DUIs and rental cars?

Specifically, BPDBioMom is coming into town and plans to rent a car to drive out of state with my 3SS to visit relatives. She had a DUI in 2011 and "refused to blow" but ended up with a breathalyzer  in her car. DH thinks she wasn't convicted ? criminally  so it may not show up on her record? I think if you have some sort of DMV restriction requiring a breathalyzer like it would show up and cause issues.

I am just concerned because she got the breathalyzer removed and is supposedly driving without restrictions since late May but I find it hard to believe that she can just rent a car easily so soon after having a breathalyzer removed.

If the vacation plans get cancelled we will be dealing with 3 unhappy SS next Tuesday and a crazed BioMom. I find it hard to believe that she (and her mother who is not coming in but paying for the rental) would assume all was ok and not check before hand but every time I rent a car I have to have my license scanned. And Bio mom is not known for her careful planning

Budget will check renters' and additional drivers' licenses to ensure that they are valid. Budget is unable to rent if the driving history reveals any of the following issues:

    invalid, suspended or revoked license

    one or more convictions for reckless driving within 36 months

    one DUI, DWI or DWAI conviction within 48 months

    failure to report an accident/leaving the scene of accident within 36 months

    possession of stolen vehicle or use of a vehicle in a crime

    expired license

    three or more convictions for moving violations within 24 months (excluding seatbelt violations)

    three or more accidents within 36 months

    other activities that suggest an unsatisfactory driving record.

My guess is most rental companies have similar policies.

Thanks-- yeah we get weird information from her on this DUI. There was also an accident with damage to other cars and possibly another driver hurt. No conviction she says but then something happened because there were huge fines, license suspensions, breathalyzer installed 2 years of drama ... . A couple years ago she wanted DH to write a letter stating that she needed her license for caring for her kids for the judge. DH refused. Not only is she living across the country from us and we have kids 90% of the time but there was no way in h+++ he would write a letter like that.

DH talked to her this morning. She is going to go on Monday to Av-s (hmmm isn't that a little last minute dear BPDmommy   ) to arrange the rental in her home state? I have no idea what her back up plan is and she is flying in here on Tuesday with SS9 and SS10 who have been with her the past few weeks.

I guess her mother could come in with her but who knows? I just know it's not going to be happy world here if all the plans get cancelled.

Ugh.

You can probably find her criminal record online, if you know the county where she was arrested.

In my state, you can go to each county's web site - the court's web site or the sheriff's web site - and look it up by name.

Then call Avis and compare their policy with what you find in her criminal record.

If there is a problem - like if Avis has a policy similar to Budget's as Catnap found it, and if she has a DUI within the last 48 months - maybe you can ask if they check or if they use the honor system.

Suppose somehow she manages to rent a car, but you think she's cheating somehow.  Then what would you do - rat her out to Avis, or discuss it with her, or let it go?

I just looked and they charge fees. grrr It's a major city in CA.

Suppose somehow she manages to rent a car, but you think she's cheating somehow.  Then what would you do - rat her out to Avis, or discuss it with her, or let it go?

Let it go, my DH and I did not plan for the boys to be with us for another week.  Selfishly need time b/c we have boys 90% of time and a few weeks of summer is only break we get. Also boys will be majorly disappointed. It's typical BPD mom planning with no back up plan except leaving boys with us -- a week early.

It's maddening though now I think she should be able to find some place that will rent based on my limited research on the net.

Oh, should add, we are not worried about her driving esp long distance. If DH felt kids were in danger we'd take action.

yea. It's actually cheap considering. maybe tomorrow.

I once paid $75 to do a background check on a boyfriend of hers she met online and moved in to her house within 3 weeks.

Car rental went ok without a hitch. I am happy that we get another week break and DSS 9,10, 15 get one more week with BioMom and her family.  Big Sigh of relief.
