How do I get my uBPDw to leave the house legally? We are both currently on the lease, month to month.

Both my D19 and I have asked her to leave, told her to leave, and she refuses and says she is getting help. I think she may have actually spoken with a T today, at least that's what she has told me.

D19 wants nothing to do with her and stands her ground and is actually very mean and direct when in conflict with her mother.

It's not a fun place to live right now, very tense and thick atmosphere.

Your help is appreciated.

Absent reporting abuse and seeking a restraining or protection order, there are two legal options that can result in a family court judge hopefully giving you possession of the apartment as soon as a temporary order... . filing legal separation or divorce.  Few here ever go the legal separation path, it's a sort of half measure and half measures don't work with acting-out PDs.  I'm not saying this is a complete answer, but that's my impression in a nutshell.  Check out your local legal options in a consultation with a family law attorney.

Oh, I just noticed the month to month status.  Find out if you can drop her from the lease.  But then you'd possibly have to evict her?  Or you have the option to move with your daughter to another apartment where your wife may have no rights.  Not sure about her not having rights since being a spouse may blur the legal lines there.

(ForeverDad, ... . is it okay for me to keep recommending to victims here on the forums to video tape, video tape, video tape, ... . document, document, document.

It is just that it has worked so well for me... . in my situation of an abusive wife/mother.  CPS does not put up with an abusive parent to the children. Having a CPS report that is very damaging against the abusive parent is soo helpful ... . at least in my situation.

Did I mention video tape and audio tape your abusive BPD relative?  VERY, Very effective.

My lawyer stated to me this: A Judge/Master of the court will NOT ever, ever put up with an adult having a temper tantrum EVER in his/her court room (yelling, screaming, nor throwing things, nor swearing, etc, (as a matter of fact such a person would be taken away and thrown into a jail cell) ... . and also a judge will NOT stand for an adult/parent doing those things in the privacy of one's home when there are children around... . NEVER... .


So, ... did I mention to video tape? (covertly ann non-covertly)
