My dd had to get her drivers license renewed this past summer. When she sat down with the person doing the renewal she told her she had just got out of rehab. this started a whole change reaction. She was sent forms for the Medical board asking for a phsyical and more information. These papers came while she was at her third rehab but when she was released we helped her do the paperwork and had her P fill out the forms. He added more detail about her more recent rehab and also her hopsitalization for suidical ideations. He did say she was stable and able to drive. This was back in August. Yesterday received a letter of Revocation of her drivers license stating that they are revoking her license and that we can request a hearing. It looks like this is going to cost for lawyer and court fees. Also a fee to reinstate her license. I am just floored and in shock that they have done this. My dd has had limited use of a car this year and we would not let her drive if we thought she was a danger. Does anyone have experience with this? Do we need a lawyer?

Yes, they eventually gave her the license, she drove into a median shortly after, thank goodness no one was hurt. It's good she has your support. Having limited driving sucks, yet on the road to recovery its going to be something you guys laugh about, it my be a blessing to. The universe has a strange way of helping us.

Oh my my! How is your d handling this? Mine would flip even now! It really feeds into their victimization perspective.
There are questions they ask... ."In the past 2 years have you been hospitalized for a diagnosed psychiatric disorder?" ":)o you take medication for any psychiatric disorders?"
While we answered truthfully, doing so in a small town probably helped my d skate through.
Refiling or filing for an appeal shouldn't require an attorney if her pdoc signed off on her getting her license... .I wouldn't think. It might not hurt though... .if you can afford it.

I have only told her she would need to go in for a meeting... .I didn't say hearing but I probably will once things get closer. I think that is the issue with her case is that she just checked alcohol/drugs and didn't check psychiatric issues. At the time my dd was doing well and had not been suicidal for some time. When she went into her third rehab after her rape is when she was suicidal and I do fell the rehab place was ill prepared for her trauma and also messed with her meds not knowing her past history. For a place with such a good reputation they were really the worst. I feel like suing them and that is not something I ever think of doing.
I am going to talk further with her after I call tomorrow and have the fully story. I really still don't understand why her license was revoked. It really makes no sense to me but I want all the info before telling dd more details.
Depending on what is said we will see if we need a lawyer. My H is so pissed about all this and that is will cost more money to fix. D will have to help out with the costs and that is not going to make her happy either.
I understand their concern but I don't understand why it is being done in this manner. I feel like my dd rights have been violated. I am hoping that once we have the hearing they will see that she is okay and capable of driving. I really wouldn't let her drive if there was an issue. She only uses the car right now for work and rarely takes it for any other reason. In fact the keys are locked up and she doesn't have free access. It is not that I don't trust her it is because it is a privilledge she must earn right now. She is still waiting on her first pay from her new job and then she can contribute more for gas etc.
I just don't know how this will unfold and if I need a lawyer.

Hi jellibeans,
My DD has been in this place, though she was no longer a minor. I went with her as an advocate to listen and testify on her behalf.
Her DMV hearing was NOT like going to criminal or civil court. It is an administrative hearing with an employee of the DMV. [DMV = Dept of Motor Vehicles] In my DD's hearing it was in an office at the driver's license office. Wish I could remember more clearly the issues. I think it had to do with a probationary license with her 1st DUI in 2009. The rules may be different now as our state has gotten tougher with DUI drivers.
Can you search out information for your state's DMV on what to expect, what to bring, what the issue is? This seems reasonable to be available before the hearing. I started with the DMV state website and the contact info. there.
I take a few deep breaths and seek ways to dispel as much anxiety as possible.Then I can better arrive with as much info as possible and a cool mind. You can be an advocate for your DD in this -- let her tell her story and answer the questions with your support.
