Son In Household With Recent DV Towards His Mother~

Hello everyone, my son's mother went to the doctor today and had to text her condition even without my asking her. She never sticks to talking about our son and brings up her ailments and drama.

The tough thing I'm dealing with is people telling me to not give my son back to her. After her bf beat her up everyone is warning me to get a restraining order on her bf to keep my son from being around him. These thoughts bring on the same desperate fear I lived with every day I was with my ex.

Legally I don't think I can just keep my son away from his mother but there is a lagitimate concern for his safety. Of coarse everyone has an opinion as to what I should do.

I feel stuck again, I've had him all day and again she only text to explain her sickness and then doesn't even ask how our son is doing.

CPS where you live may have an anonymous reporting line. Can you look and make a call?

I had to make a report to the police a year ago for something the kids' uncle did, not my Ex or her husband. I learned that it's the responsibility of parents to keep our kids safe, no matter such circumstances. With shared custody, and a court order, it's more complicated, but I was told it still stands.

I did make a report to cps a few days ago, they explained there isn't much they can do, they insist I go through the court to have my son removed from his mother.

Hello and thank you everyone for your support

I'm going to file a restraining order Monday and let the judge determine the right coarse of action. My sponsor told me to file because it is the right thing to do, he said once I file the judge may be more persuaded to give me full custody in the future.

There was abuse and charges were filed so no disputing the facts, and asking my ex about the incident would only disturb her and I wouldn't get the truth anyway.

Each agency has its own fiefdom or realm of authority.  The police have their area of expertise and authority. CPS or children's services has theirs.  Doctors and hospitals have theirs.  Custody Evaluators have theirs.  Court has its too.  Frustrating for us to go from one to the next.  But it is in court where it all gets wrapped up into one neat bundle.  Well, that's how it is supposed to be... .
